The Federal regulation concerning the distribution and return of prescription drugs summarized below, is detailed as part of the Prescription Drug Marketing Act ("PDMA").

This regulation requires that health care entities returning prescription drugs document that the product was kept under proper storage and handling conditions while in their possession, and during the return of the product. The regulation also requires the health care entities to forward a credit memo to the wholesale distributor and the drug manufacturer, and retain a copy for his or her records. A "health care entity" is defined in the PDMA as any person that provides diagnostic, medical, surgical, or dental treatment, or chronic or rehabilitative care, but does not include any retail pharmacy or wholesale distributor.

In order to comply with this regulation, Henry Schein, Inc. ("HSI") any customer returning prescription drugs must complete and return the Prescription Drug Return Authorization Form.
